CIDB

Objective of CIBD is to develop the capacity and capability of the construction industry through enhancement of quality and productivity by placing great emphasis on professionalism, innovation and knowledge in order to improve quality of life. Acquiring a CIDB license is compulsory for all types of companies operating in the Malaysian Construction Sector, whether they are foreign or local. This license is renewable and valid for a period of a minimum of 1 to 3 years. License holders will need to pay a certain tax when applying according to the grades of CIDB variation.

There are 7 specified registration grades for each category as below and a contractor is not entitled to undertake any construction project which exceeds the value of the construction works specified in the registration grade. There are fees payable to CIDB that varies according to the registration grades.

• G1 not exceeding RM200,000
• G2 not exceeding RM500,000
• G3 not exceeding RM1,000,000
• G4 not exceeding RM3,000,000
• G5 not exceeding RM5,000,000
• G6 not exceeding RM 10 Mil
• G7 with no limit

Foreign Contractor Registration

Foreign contractors registration is project-based. The certificate of registration allows the holder to only execute the project specified in the certificate. The foreign contractor has to apply for an extension of the validity of the certificate within 14 days before the expiry of the validity of the certificate

Levy on Contractors

A CIDB registered contractor is bound to notify the CIDB of any contract which he has executed of a sum of more than RM500,000. The percentage of levy is calculated as 0.125% of the contract sum by Regulation 2 of Lembaga Pembangunan Industri Pembinaan Malaysia (Imposition of Levy) Order 2003 from 21.05.2003 onwards

Fine on No-Notification

If the contractor has not notified CIDB regarding the contract executed in an amount of more than RM500,000, the contractor shall be liable to a fine of RM5,000. Any further amount of levy payable may be recoverable as a civil debt due to CIDB.

MIDA

If a manufacturer meets a certain requirement, the law requires it to obtain a manufacturing license from Malaysia Investment Development Authority (MIDA) The manufacturing license is a legal premise for a company/factory to conduct orderly manufacturing activities in Malaysia under the provision of the Industrial Coordination Act (ICA) 1975. Upon receiving the license, the manufacturer should fulfil the following criteria:

• Paid-up capital/shareholder’s fund to be equal to or more than RM2.5 million or
• Employees under the company to be equal to or more than 75 people

MIDA requires manufacturers to present their manufacturing license to obtain exemption on import duty tax on raw materials and components used in production of finished goods.

Additional advantages includes Pioneer status (Ps) or Investment Tax Allowance (ITA). Business with Pioneer Status will have tax exemption from 70% to 100% of statutory income for 5 to 10 years. For  investment tax allowance, a company can get allowances between 60% to 100% on qualifying capital expenditure that incurs which involves equipment, machinery, factory and others used for an approved project incurring within 5-10 years.
